The Fair Debt Collection Practices Act – The Big Stick
The greatest weapon available against bill collectors and other abusive debt collection practices is the Fair Debt Collection Practices Act, or the FDCPA for short. This federal law bans unfair debt collection practices like those described above. At least, the FDCPA bans such actions by bill collectors working for collection agencies. It doesn’t apply to the practices of individual creditors attempting to collect money owed to them.

The fiscal year for the federal Judiciary ends September 30. The calendar year ends December 31. Quarterly and 12-month statistics are available approximately 2 months after the close of a quarter.

Chapter 7 Bankruptcy
This is the most common chapter in personal bankruptcy. Other objectives in filing a Chapter 13 case is to pay debts not otherwise discharged, such as taxes or support, or simply to make partial payments to unsecured creditors. Because of complexities of filing Chapter 13 paperwork in the Sacramento/Modesto Bankruptcy Courts, solid knowledge of the local filing requirements is a must to successfully file and navigate through a Chapter 13 case.
